从辽宁贿选案等看我国人大代表大规模贿选的治理

A Look at the Prevention of Large-Scale Electoral Bribery in the Election of China's NPC Deputies from the Election Fraud in Liaoning Province

当前地方人大代表选举中的贿选屡禁不止,已呈愈演愈烈之势,具有多发化、扩大化、高层化、巨额化、多样化、掮客化、公司化、系统化、公开化、老板化等特点。导致大规模贿选爆发的根源有作为理性人的个体追求其利益最大化,一把手领导不力、监督失位、惩处不严、选举制度缺陷、相关法律漏洞和政治生态恶化等主客观因素,为此,当采取先遏制,后根治的治理策略,通过加强并规范一把手对人大选举工作的领导,加强监督,严厉惩处,堵塞制度漏洞,完善相关法律,净化政治生态等具体措施,标本兼治,有效杜绝大规模拉票贿选案件的再度发生。

At present, electoral bribery persists in the election of China＇ s National People＇s Congress （NPC） dep-uties ,especially at local levels, undermining the people ’s congress system,the socialist democratic politics and the state laws and Party disciplines. However, the occurrence of large-scale electoral frauds is deeply rooted in both subjective and objective factors such as weak law enforcement by the election-organizing institutions and responsible persons, lack of effective supervision in the election process, limited or too lenient punitive measures against rigging practices, deficiencies with the electoral institutions or systems, et cetera. Therefore, a “ zero tolerance” approach should be implemented to eradicate election rigging and malpractice in the election of NPC deputies in order to safe-guard the authority and dignity of the people5 s congress system and the socialist rule of law.
