摘要
我国体育产业的迅猛发展,以及网络盗播对权利人的巨大冲击,对法院如何给予体育节目法律保护提出了相当高的要求。与邻接权保护模式和反不正当竞争保护模式相比,版权保护模式能够更有效地维护网络市场的健康发展,给予体育产业更充分的激励,并能为体育产业的国际化提供国际版权公约的充分保障,所以应当将版权作为体育节目保护法律依据的首选。
The rapid growth of the Chinese sports industry and the significant impact of Intemet piracy call for effective legal protection for sports programs. Copyright protection is clearly superior to neighboring right and unfair competition protection to the extent that the former may better safeguard the healthy development of the Internet market, provide sufficient incentives for the sports industry and facilitate globalization of the sports industry by making available favorable treatments under international copyright treaties.
