同人作品的著作权问题研究——以《此间的少年》为例

A Study on the Legality of Fan Fiction

同人作品产生并广泛传播于网络中,对原作品具有一定依赖性,但是又具有其独创性。因此,其是否受著作权法保护享有著作权、是否侵犯原作品著作权以及是否构成不正当竞争已经成为学界争论焦点。尽管与原作品可能会产生著作权上的冲突,但是基于其自身特性和公共利益的考量以及社会文化发展的需要,法律不应当完全否定同人作品的合法性,而是应在明确其法律属性基础上规范其合法性要件,寻求合理保护原作品权利人合法权益的方法。

Fan fiction is widely disseminated in the network. Its production is based on the original works, but also has its owndependent value. Whether it is entitled to copyright law protection, and whether it infringes original works and constitutes unfair competition are being enthusiastically debated among academia. Although it may have copyright conflict with the original works, considering its own value, the public interests and the needs of social and cultural development, the law should not completely deny the legality of fan fiction. The law should,while clarifying its legal attributes, make efforts to lealized fan fiction and seek a reasonable protection for it.
