海运危险货物谎报瞒报案件行政处罚调查程序规范研究

Research on the investigation procedure of administrative penalty on false declaration of marine dangerous cargo

作为海运危险货物安全监督管理的主管机关,海事管理机关持续强化海运危险货物运输管理,加大对海运危险货物谎报瞒报案件的查处力度,取得了一定的成效。文中通过分析危险货物谎报瞒报案件行政违法行为主体,货物性质判定、违法行为性质,法律法规的要求,指出行政处罚调查过程中面临的诸多问题,提出处理此类违法案件的调查程序规范。

As the competent authority for the control on the maritime transportation of dangerous goods, the maritime safety administration has been continuously enhancing the control on the maritime transportation of dangerous goods and strengthening the investigation and handling of relevant cases involving false report or concealment, which has yielded certain effect. The paper analyzes the subject for such cases of false report or concealment as well as the properties of the goods, the nature of the illegal practice and related laws and regulations. It points out the problems identified during the investigation in administrative punishment and proposes the investigation procedures and rules for handling cases involving such illegal practice.
