论国有企业廉政监督制度建设的三个层次

On the Three Levels of the Supervision of the Clean State-owned Enterprises

在理论界和实践中,对国有企业廉政建设的关注程度低于对政府部门的廉政监督的关注程度,国有企业廉政监督亟待加强。廉政监督制度建设的第一个层次从制度的原则入手进行。原则充分反映国有企业廉政监督制度目标与国有企业发展目标的一致性的要求。在国有企业运营中实施国有企业廉政监督,在反腐倡廉的同时,促进国有企业健康发展。第二个层次是具体的廉政监督制度建设,从内部监督和外部监督制度建设着手,通过制度创新从源头预防腐败发生。强调廉政监督制度与国有企业经营管理制度的高度结合。第三层次的对国有企业高管行为的廉政监督制度建设,从规范、处理、预防方面入手,不仅通过党纪,还应当通过法律制度对国有企业高管的行为进行约束。对高管的行为规范与对国有企业管理人员廉政教育、自律结合。国有企业廉政监督制度建设的三个层次是有机联系的整体。

In theory and in practice, less attention has been paid to the supervision of the clean government compare to the construction of clean State-owned enterprises, therefore the supervision of State-owned enterprises should be strengthened. The first level of the construction is to start from the principles of the system. The principles fully reflect the accordance between the goal of the supervision system of State-owned enterprise and the goal of the development of State-owned enterprises. In the State-owned enterprises, the implementation concerning the supervision of clean State-owned enterprises can not only fight against corruption but also promote the healthy development of State-owned enterprises. The second level is the specific supervision system construction of the clean government,which starts from the construction of the internal and external supervision and can prevent corruption from the source through the system innovation. And a highly close combination of the supervision and the management of State-owned enterprise system needs to be emphasized. The third level is the supervision system construction of the executive behaviors. Considering the norm, treatment and prevention, we should constrain the behaviors of State-owned enterprise executives not only through the party discipline but also the legal system. It＇s suggested that the code of conduct for executives, the education of State-owned enterprise personnel and discipline should be combined. The three levels of the supervision system construction of the clean State-owned enterprises are closely related and are regarded as an organic whole.
