民间融资犯罪化的价值、问题及理念转换

民间融资犯罪化是指对民间融资过程中的严重违法行为进行犯罪化。之所以要进行这种犯罪化,是因为民间融资的非正规性、隐蔽性、缺乏有效监管性导致融资过程中极易出现非法集资等违法犯罪行为。特别是其中的犯罪行为,对道德伦理、公民财产利益、社会稳定、国家金融秩序都会造成极大破坏,所以,要明确民间融资犯罪化的必要性和可行性,正视犯罪化过程中的行为调整偏差、背离刑法基本原则、忽视立法技术等问题,一改传统的经济统制思想,完善民间融资法律体系,明确经济犯罪属性,秉承谦抑立场,遵循刑法基本原则,将民间融资领域中的经济犯罪确定为二次违法。

Private financing criminalization is a kind of criminalization of serious criminal offence in the process of private financing. Due to irregularity and concealment of private financing and lack of effective supervision, some criminal behaviors such as illegal fund - raising easily occur in the process of financing, which can greatly undermine morality and ethics, citizens＇ property interest, social stability and financial order, etc. Therefore, we shall clarify the necessity and feasibility of private financing criminalization; face squarel y some problems in the process of criminalization including behavior adjustment error, deviation from basic principles of criminal law, neglect of 1 egislation technology, etc, improve legal system of private financing, changing traditional economy -oriented concept. Besides, crime, follow the basic principles of criminal law and identify economic we shall define property of economic offence in the field of private financing as a secondary law -breaking, adhering to the standpoint of austerity.
