Analysis on the process of judicial adjudication from the perspective of game theory

博弈论作为一个研究理性人的互动行为或是研究交互决策的理论方法,用于分析司法裁判具有可行性和很大的实用价值。在司法改革中,博弈论的引入有利于改革者准确地理清在改革的过程中所涉及的各利益群体复杂的利益关系及其相互间的冲突与博弈,通过对不同利益群体可能做出的行为及其结果进行分析与衡量,并在各利益方的冲突中寻求可能的合作,选择最佳的策略以使改革将带来的成果达到帕累托最优。

As a theoretical way to study rational interaction behavior or interactive decision-making,the method of game theory,used for the analysis of the judicial referee,has feasibility and great practical value.In judicial reform,the introduction of the game theory is helpful for reformers to disentangle the complex interest relations and mutual conflict and game of various interest groups involved in the process of the reform.Through analyzing and weighing the behaviors and the possible results of different interest groups,and to seek the possibility of cooperation in the conflict interest group,the choice of the best strategy enables the reform to achieve the Pareto optimality.It also has great inspiration and reference to the construction of socialist legal system in China.
