从某种意义上讲,中国刑事诉讼制度改革发展的历程就是刑事诉讼制度立法变革的过程。相比于西方法治国家,中国刑事诉讼制度立法变革在展开路径上既复杂又独特,自然也有着自身的独有特质。这是由其所处外部复杂环境及其形塑而成的多重机制共同铸就的。中国刑事诉讼制度立法变革取得了巨大成就,当然也存在一些问题。刑事诉讼制度未来的立法变革应该从中吸取经验教训。

In some sense,the process of reform and development of China＇ s criminal procedure system is the process of the legislative transformation of criminal procedure system. Compared with the western countries under rule of law,the legislative transformation of China＇s criminal procedure system has a both complex and unique path and its own unique characteristics,which are formed not only by the external complex environment but also by its shaped multi-mechanism. The legislative transformation of China＇ s criminal procedure system has made great achievements. However,there are still some problems,from which the future legislative transformation of criminal procedure system will draw some lessons.
