Research on Company Law Control Agreement System of OHADA

OHADA是非洲统一商法组织的(L′Organisation pour l’harmonisation en Afrique du Droit des affaires)缩写。该组织成立于1993年,旨在促进地区交流和投资,保证成员国商法和司法活动正常进行。目前,OHADA体系下有九部统一法。文章介绍《商业公司与经济利益集团统一法》(以下简称"统一公司法")中管制协议的构架,以指导中资企业对当地公司的治理和管理。

OHADA is the acronym of ＂L＇ Organisation pour l＇Harmonisation en Afrique du Droit des Affaires＂. It is a unified commercial organization of Africa. The organization was established in 1993 to promote regional exchanges and investment, and ensure the normal conduct of commercial and judicial activities in member countries. At present, there are nine unified laws under the OHADA system. The article introduces the framework of the ＂Uniform Law of Commercial Companies and Economic Interest Groups＂ （hereinafter referred to as the ＂Unifi Inc Law＂）, so as to guide the management of the local companies by the Chinese funded enterprises.
