刑事政策与刑法体系的关联性展开——从“李斯特鸿沟”到“罗克辛贯通”的理性审视

On the Extension of the Correlation between Criminal Policy and Criminal Law System——A Rational Examination from “Liszt Gap”to“Roxin Through”

在法规范的存在与价值上,实证主义刑法强调形式上法律权威的合法性以及刑法规范的封闭性,因而作为价值填充的刑事政策应脱离刑法教义学。然而,从"费尔巴哈分立""李斯特鸿沟"到"罗克辛贯通",均以刑罚作为串联二者的线索,刑事政策逐步进入犯罪论体系,正式全面介入刑法体系。在这一演变过程中,刑事政策与刑法体系并未彻底分离,其关联性呈现出互相依附、逐渐疏离和重新复归的趋势,关联机能得到强化,互补、互动关系得以正当化。

In terms of the existence and value of legal norms,positivist criminal law emphasizes the legality of formal legal authority and the closure of criminal law norms respectively.Therefore,the valuefilling criminal policy should break away from criminal law dogmatics.However,from Feuerbach Separation,Liszt Gap to Roxin Through,penalty has become the cue to connect each other,and criminal policy is gradually entering criminal theory system and formally involved in the criminal law system.In the process of the evolution,there is no complete separation between criminal policy and criminal law system.Its relevance presents a trend of mutual dependence,gradual alienation and reversion,strengthening the correlation function and legitimating the relation of complementary and interaction.
