惩罚性赔偿在我国环境侵权中的适用研究

On the Application of Punitive Damages in China's Environmental Infringement

惩罚性赔偿在我国环境侵权中的适用存在争议。环境侵权的特殊性决定了惩罚性赔偿的适用具有必要性。我国《消费者权益保护法》《食品安全法》《商标法》等法律中的惩罚性赔偿制度为其在环境侵权领域适用提供了立法基础。文章提出环境侵权领域构建惩罚性赔偿制度的若干建议,进一步论证惩罚性赔偿在环境侵权中的适用具有可行性。

The application of punitive damages in environmental infringement in China is controversial.The particularity of environmental tort determines the necessity of the application of punitive damages in environmental infringement of our country.At the same time,the application of punitive damages in China＇s ＂Consumer Protection Law＂,＂Food Safety Law＂,＂Trademark Law＂and other laws provide justification for its application in environmental infringement.Furthermore,putting forward some suggestions on the construction of punitive damages system of environmental infringement to prove the feasibility of the application of punitive damages in environmental infringement.
