农村房屋买卖纠纷现状考察及解决路径探析 被引量:1

摘要 典型的农村房屋买卖纠纷主要集中在两方面:一是发生在同一农村集体成员之间由于登记手续欠缺引起的纠纷;二是集体组织以外的农民以及城镇居民购买农村房屋的买卖合同效力问题引起的纠纷。现行法律法规对于农村房屋登记等存在缺失以及农村房屋买卖合同的效力不明确导致司法实践的审判结果不统一。从法理层面、制度层面、社会效果层面等分析农村房屋买卖合同效力判定及合理性。我国应构建科学系统的农村房屋买卖法律体系以及配套制度来保障农村房屋买卖合同的效力。具体包括:建立关于农村房屋买卖以及农村宅基地使用权流转等专门立法,以弥补农村房地产立法方面的缺失;基于房地分离模式基础上引入法定租赁权制度;明确农村不动产物权变动模式等。 There are two typical rural housing sale disputes, one is the dispute between members of the same collective because of incomplete registration.The other is the dispute of urban residents buying rural housing ~ Existing laws and regulations in china is lack of rural housing registration and .effectiveness of the sale of rural housing contracts.It leads~ to different results in .judicial practice.Based on the analysis of the legal level, system level, social effect this paper points out that the rural contract should be effective..we aims to establish a scientific system and supporting system for the effect of the rural contract.Some special legislation of rural housing and rural land should be established to make up for the lack of rural real estate legislation.On the basis of tthe real estate separation mode we should make introduction of the system of statutory tenancy rights. Rural real property transfer mode should be established etc.
