Legislative Proposals on Basic Medical Health Law——Starting with Some Basic Concepts

卫生立法是实现卫生与健康的关键。我国医疗卫生领域内诸多制度,在医药卫生体制改革中通过法律固定下来;同时,实践证明行之有效的经验和措施也需要及时上升为法律,以实现制度法律化和法律制度化。本文以"医疗卫生服务""基本医疗(卫生)服务""基本医疗卫生法"三个基本概念为出发点,在分析三者各自的含义及其相互之间的联系的基础上,为卫生立法提出立法建议。

Sanitation and health is the theme of health development in China, and health legislation is the key to achieve this goal. With the further advancing of medical and health system reform in China, many systems in the field of health care need to be fixed by law. At the same time, the practice proves that effective experiences and measures also need to be legitimated in time to realize the dialectical unity of institutional legalization and legal institutionalization. With the three basic concepts（＂the medical and health services＂, ＂basicmedical （health） services＂, and＂Basic Medical Health Law＂）as a starting point, based on the analysis of the respective meanings and their mutual connections, this paper put forward legislative proposals for health legislation.
