摘要
《侵权责任法》第七章为医疗纠纷案件的处理提供了直接的法律依据,其说明义务成为一项重要的法律义务,但实务中该义务却往往没有被不履行或履行不充分。本文以一则案例为引导,探讨医务人员说明义务相关的法律制度。
The seventh chapter of Tort Liability Law provides direct legal basis for medical dispute cases. Among them, the duty of explanation becomes an important medical legal obligation determined by this law. But in medical practice, this obligation is often not fulfilled or inadequately fulfilled. This article takes a case as the guide to discuss the legal system related to the medical staff＇s duty of explanation.
