Study on the Governance Accountability of Administrative Law

随着政府管理向公共治理的转型,传统由行政机关担负的管理责任也开始向多元主体共同承担的治理责任转型,治理责任对行政法治具有重要意义。治理责任是涵盖所有治理主体和整个治理过程的责任,既指向政府责任,又指向扮演公共治理角色的其他主体所应当负有的责任;既包含治理主体应当担负的事后责任,又包含保证治理主体负责的一系列制度工具。治理责任的框架可以从责任承担主体、责任对象、责任承担标准、须负责的事项、程序性要求以及责任产生的结果六个方面展开。

With the transformation from government management to public governance, the government＇ s traditional management accountability has also begun to turn to the governance accountability, which is very important to administrative rule of law. Governance accountability covers all the governance bodies and the whole process of governance, including government accountability and private parties accountability, legal liability and answerability tools which ensure governance bodies accountable. The framework of governance accountabil- ity involves several elements, （1） Who is accountable？ （2） To whom？ （3）According to what standards？ （4） About what？ （5） Through what processes？ （6） With what effects？
