民法总则新规则对编修民法分则各编的影响

Influences of New Rules in General Principles of the Civil Law on Volumes in Compiled Specific Provisions of the Civil Law

《民法总则》规定了民法的基本原则和一般规则,都在《民法通则》的基础上进行了重大改革,制定了诸多新规则。立法机关已经开始编修民法分则各编,《民法总则》新规则对民法分则各编的编修会发生怎样的影响,必须作出评估,并且做出相应的编修对策。《民法总则》规定的民法基本原则,以及民事主体、客体、民事权利和义务、民事法律行为、代理、民事责任和诉讼时效等新规则,都会对民法分则的物权编、合同编、侵权责任编、婚姻家庭编和继承编发生重大影响。民法分则上述各编在编修中,必须符合《民法总则》规定的上述制度的新规则,同时也应当对《民法总则》与民法分则各编可能发生的重合和冲突予以协调,形成民法典逻辑结构和谐、内容分配妥适的严密体系,使之成为我国的民法根本大法。

General Principles of the Civil Law has made a lot of new rules compared with the old version.Legislation has begun to compile each volume in Specific Provisions of the Civil Law,thus the evaluation and the strategies must be given to the compilation.The basic rules and the new rules of subject,object,rights and obligations,legal act,agency,limitation of legal proceedings,etc.in General Principles of the Civil Law will greatly influence the volume of property,the volume of contract,the volume of tort liability,the volume of marriage and family,and the volume of inheritance.The compilation of the former volumes must be consistent with the new rules,and be reconcilable with the possible coincidence and contradiction,in order to generate the national civil law,which is logically structured and appropriately distributed.
