基于共同体理论对土地复垦监管展开方法论层面的本源式研究,有助于重构相关监管机制的理念模式,以实现对既存现实问题的整全性校正。土地复垦监管共同体是一种存续于土地复垦领域,以有效解决相关监管机制中各类具体问题的共同社会治理生活。其成就与否,往往取决于共同体所特有的关系属性、功能属性能否在土地复垦监管中彰显出来。该类共同体应具备的互助性关系属性往往通过共同体成员之间的互助,以及共同体与其成员之间的互助而显现出来;当基于其互助性关系属性来诠释土地复垦监管法律关系的主体、客体及内容。该类共同体应具备的自足性功能属性往往通过共同体系统调整功能与纠纷解决功能的自足性而显现出来;当基于其自足性功能属性来调整土地复垦监管规范设定理念,并就相关规范设定中不够周延的相应主体规范、权属规范、保证金规范来予以充实。

Based on the community theory,this paper explores the methodology of the land reclamation regulation studies.Such studies are conducive to reconstructing the conceptual model of relevant regulatory mechanism in order to make a comprehensive correction in solving the existing problems.Land reclamation regulatory community is a co-social governance life,working in the field of land reclamation,which aims to effectively solve all kinds of practical issues inside the relevant regulatory mechanism.Whether it works or not depends on whether or not the relationship attribute and functional attribute of the community can be manifested in the land reclamation regulatory.The mutual aid relationship attribute of this kind of community often be manifested through the mutual aid between members of the community and the mutual aid between the community and its members.We should interpret the subject,object and content of the land reclamation regulatory legal relationship based on its mutual aid relationship attribute.The self-sufficiency functional attribute of this kind of community can often be manifested through the self-sufficiency attribute of the community's system adjustment function and dispute resolution function.We should adjust the ideas of land reclamation regulatory norms setting and enrich the corresponding subject norms,ownership norms and margin norms which aren't enough comprehensive in the relevant norms setting based on its self-sufficiency functional attribute.
