印制电路板印刷环节的行政监管之法理释义

Legal Interpretation of Administrative Supervision of Printed Circuit Board Printing

印制电路板生产无疑会涉及到印刷环节,然此环节之印刷,不论从文义解释、目的解释还是体系解释上看,均不应被视为《印刷业管理条例》所规制的印刷行为。从历史解释的角度看,印刷业行政监管法规的中外发展史都将尊重市场化发展规律,不断缩小印刷监管范围作为立改废的方向。因此,凡是在新技术产业领域涉及到的印刷过程均不受印刷行政主管部门的监管,《印刷业管理条例》中的"印刷"应当作严格意义上的限缩解释。

The production of printed circuit board will undoubtedly involve the printing sector. However, the print- ing in this process, whether it is explained from literary content, purpose or system, should not be regarded as the printing practice regulated by ＂Printing Industry Regulations＂. Besides from the perspective of historical interpreta- tion, the history of chinese and foreign development of administrative supervision in printing industry has taken the respect of the law of market development and the continuous reducing of the printing supervision scope as the direc- tion of establishing, modifying and abolishing reform. Therefore, the printing process involved in new technology industry is not subject to the supervision of the printing administrative department ; the ＂printing＂ in ＂Printing In- dustry Regulations＂ should be strictly limited in the sense of interpretation.
