The Responsibility Investigation for Netizens' Critical Expressions Should Embody Modesty of the Right

与一般的实害犯罪类型不同,网民针对地方公权力不当行为的批评作为公众舆论形态对国家安全、国家利益、社会利益并非必然产生即刻的、现实性危害,责任追究应严守"实害性结果"标准,以体现权力应有的谦抑品质;地方权力意志使惩罚要件"虚拟化",即危害"社会秩序和国家利益"所指缺乏确定内涵且成为案件"公诉化"理据,是权力缺乏谦抑性的另一表征;"社会危害性"的判断缺乏应有的辨析,即失范的网络批评表达所致社会危害性并非必然等同于不可恢复的社会关系损害,亦是权力乏谦抑品质的体现。

The netizen criticizing misconducts of the local authority is different from the general actual damage offence, which may not produce immediate and actual damage for national security, na-tional interests and social interests. The responsibility investigation should abide by the standard of “harmful result” in order to embody modesty of the right. The will to local power makes the punish-ment events virtualized, that is , one character of the right lacking modesty is that the referent of dam-aging social order and national interest lacks the specific content and also becomes the theoretical ba-sis of cases’ public prosecution. The judgement of social harmfulness lacks appropriate analysis, that is ,social harmfulness, caused by netizens, wrong critical expressions, may not cause the irreversible harmfulness for social relations, which also embodies modesty of the right.
