摘要
绩效管理的制度化使法律制度成为可度量的尺度,使法律绩效的考核与评估成为现实。《中华人民共和国预算法》对于国家各级政府、各部门的公共支出提出了绩效管理的基本要求,成为绩效管理制度化的基本法律依据。考察我国目前能源相关立法,尚没有在法律层面对能源绩效管理作出专门的规定,未来的《能源法》应当在能源绩效管理方面予以突破。能源低碳转型绩效法律制度包括实体性规范和程序性规范。能源低碳转型要求在转型法律制度设计时设定合理的低碳绩效目标及相应的绩效指标体系。能源绩效制度的实施程序包括提交年度绩效计划、绩效计划的审核与批复、编制能源低碳转型绩效报告、组织能源转型绩效评价,在能源转型匹配法律制度建设的同时,完善能源转型实现机制,切实、有效推进能源转型进程。
The institutionalization of performance management makes the legal system a measurable yardstick,and makes the assessment and evaluation of legal performance come true. Budget Law of the People's Republic of China raises a basic requirement for the performance management of the public expenditure of governments and departments, making it the legal basis for the institutionalization of performance management. China's current energy related legislation has not yet made specific provisions in the face of the legal aspects of energy performance management, so the energy law of the future should break through in the management of energy performance. The legal system of low-carbon transition performance includes substantive norms and procedural norms. The low-carbon energy transformation requires setting reasonable low-carbon performance goals and corresponding performance indicators system in the design of transition legal system. The implementation procedures of energy performance system include the submission of annual performance plan, performance plan review and approval, the preparation of energy low-carbon transition performance report, and organizational performance evaluation of energy transformation. We should improve the mechanism of energy transformation in the transformation of energy matching legal system construction, and effectively promote the process of energy transformation.
