乾隆朝归绥地区蒙汉案件的司法审判程序初探

A Preliminary Study on the Judicial Proceedings of the Cases of Mongolia and Han During the Qian Long Dynasty

清代归绥地区是蒙汉杂居地区,该地区蒙汉案件审理中面临着不同行政主体管辖与法律适用等问题。拟以乾隆朝归绥地区的蒙汉案件为例,依托满文、汉文史料,探讨当时清朝如何在归绥地区平衡不同行政主体的执法权与不同法律的适应问题,并通过案件的司法判决观察归绥地区司法的变化情况,以便更深入地观察清代司法在蒙汉民众聚居区的运作及其区域性特征。

During the Qing Dynasty,GuiSui was such a region,mixed with the Mongolian people and the Han people. When the head of the area tried the casehe faced the question of whether to use the Mon-golia statutes or the Qing statutes. This paper try to discuss the Qing Dynasty how to balance the right of law enforcement of different administrative bodies. According to the judicial judgment of the cases？ We can examine the changes in the judicial situation in GuiSui. Also？ we can have a deep understanding of the laws how to run in the inhabited area mixed with Mongolian and Han people.
