行政审批是一种管控制度,是行政主体根据法定授权对社会主体采取的规范行为、保障权利、维护秩序、限制活动的行政措施。行政审批是行政权力对社会主体的行为进行一定的限制和控制,但既要运用行政权力规范社会主体行为也要防止行政权力滥用,故行政权力、社会主体权利与公共利益三者之间应保持一定程度的平衡。可以采取成本效益核算、最低限度限制、正当程序等基本方法实现平衡,通过测量、"计算"方式监测行政权力控制社会主体的力度和限度,以促进行政审批管控社会最佳状态的实现。

Administrative examination and approval is a controlling system in which administrative subject takes administrative measures on social subjects in the aspects of behavior regulation,right guarantee,order preservation and behavior restriction.Administrative examination and approval is behavioral restriction and control of administrative rights to social subjects.The restriction of administrative rights on social subjects and reduction of excessive use of administrative rights should be both focused on,thus,administrative rights,rights of social subjects and common interest should be balanced.Measures such as cost-effective accounting,minimum limits and due process should be taken to realize the balance,while the depth and limits of administrative rights on social subjects should be supervised through measurement and calculation,so as to realize the best control of administrative examination and approval over society.
