检察规律下检察人员分类管理研究——以检察官独立性为视角

Study on Classified Management for Procuratorial Personnel Based on the Procuratorial Rule: From the Perspective of the Independence of Procurator

检察规律是检察机关在开展检察活动、履行法律监督职责过程中形成的决定检察活动本质特性和发展趋势的客观联系。检察活动只有在检察规律的引领和指导下,才能保证检察权的公正高效行使。检察人员分类管理改革作为当前检察改革的重点之一,应当遵循检察规律对检察官行使检察权的具体要求,在保障检察机关独立性的同时,保障检察官独立,进而使检察活动体现监督属性、司法属性,推动检察权运行机制的健全。文章从当前行政管理体制下检察管理的弊端入手,综合检察活动的基本属性和检察权的运行机制对检察人员分类管理的要求,提出检察规律下检察人员分类管理的实现路径。

The procuratorial rule is used to determine the essential,characteristic and development trend of procuratorial activities,which is formed during the process of procuratorial activities and implementation of legal supervision. In procuratorial activities,procuratorial authority could be implemented fairly and effectively with the guide of procuratorial rule. The classified management for procuratorial personnel,as one of the procuratorial reforms,should abide by the procuratorial rule which requires the independence of relevant procuratorates and procurators so that supervision and judicial attributes could be guaranteed,and the procuratorial authority could improve. From the viewpoint of disadvantages of current procuratorial management,the paper studied basic attributes and of procuratorial activities and requirements of classified management for procuratorial personnel,and finally proposed the method to achieve classified management for procuratorial personnel under the procuratorial rule.
