摘要
教师身份、职业的特殊性,决定教师性侵未成年学生在行为人、被害人、行为方式等方面都呈现出不同于其他主体性侵未成年人犯罪的特点。教师性侵未成年学生既有教师个体的原因,也有家庭、学校对未成年人缺乏性知识教育以及传统性观念影响等多方面原因。应对教师进行人性化关怀,强化师德师风建设和健全考核机制;完善性侵未成年人立法和与教师、教育相关的法律、法规,构建家庭、学校、社区、社会公益组织对未成年人性健康教育和防性侵的多方互动机制,创造健康、安全、和谐的未成年人成长环境。
Compared with other people sexually assaulting children under the age of 18, teachers are much different in many aspects, especially crime subject, crime object and crime objective aspects because of the special identity and profession of a teacher. Teachers' sexually assaulting juvenile students is partly due to personal reasons and partly owing to the absence of juvenile's sex education carried by families and schools as well as traditional sex opinions, and so on. Teachers should be made to accept humanity concern. It~ necessary to strengthen the building of teachers morals and perfect the evaluation mechanism; ItS also essential to improve the legislation of sexually assaulting juveniles and laws related to teachers and education to form a multi -interaction mechanism in which families, schools , communities and social public welfare organizations will teach juveniles the healthy sex information and the prevention of sexual assault so that there will be created a healthy, safe and unisonous environment for juveniles to grow.
