论环境公益诉讼的主要困境与现实出路——以水污染司法治理模式构建为视角

On the Main Dilemma and Realistic Solution of Environmental Public Interest Litigation:From the Perspective of the Construction of Judicial Control Mode of Water Pollution

当前,水污染问题已经成为严重制约我国经济发展转型与人民生活质量提高的瓶颈。为有效防治水污染,近年来各地开展了广泛的实践,也取得了不小的成效。但随着治污实践的深入,传统行政治理模式单一、"治本"作用有限等问题也逐渐暴露出来,亟待通过司法治理模式进行有益补充。其中,新型的环境公益诉讼模式因与水污染治理具有高度的契合性而成为关注的重点。在未来水污染治理长效机制的建设过程中,相关立法、行政、司法机关应着力构建符合我国现实国情的环境公益诉讼制度并积极开展司法实践,以有效预防和制止水污染行为的发生,促进环境保护与社会公平。

At present, the problem of water pollution has become a bottleneck restricting the transformation of our economic development and the improvement of people＇s living quality. In order to prevent and control water pollution effectively,all over the country have carried out extensive practice in recent years. However,with the pollution control practice,the problems of the traditional administrative management mode is single and the ＂curative effect＂is limited,which are gradually exposed. So it is urgent to increase the judicial mode as a beneficial supplement. As a kind of the mode of judicial control,the environmental public interest litigation fits with the water pollution control to a large extent. For this reason,it has become the focus of attention. And in the process of building the long-term mechanism of water pollution control,the relevant legislative,executive and judicial organs should strengthen the construction and practice of the environmental public interestlitigation system,which will effectively curb and prevent water pollution behavior and promote water resources protection and social equity.
