摘要
2015年修改后的《行政诉讼法》以及相关司法解释明确了司法权对部分抽象行政行为——即规范性文件——的有限监督权,但其司法审查方式仅为附带性审查,要求法院对被认定为欠缺合法性的规范性文件采取一种非判决式的处理方式,以期从源头上防止基于不合法规范性文件而产生的行政行为失序现象的发生。但具体的适用规则是规范性文件司法审查制度能否落地生根的必要条件,规范性文件的司法审查必须就具体的规则进行全方位地思考。
In 2015, the revised administrative procedure law and the relevant judicial interpretation made clear that the ju- dicial power has limited supervision over some abstract administrative acts, namely, normative documents. Requesting the court must take a non--judgment--processing mode on being identified as normative documents lack of legitimacy, in order to prevent the occurrence of the disorder phenomenon of administrative acts based on illegal normative documents from the source. But the specific application of the rules is the prerequisite that the judicial review system of normative documents can be plan- ted, the full range of thinking based on specific rules on the judicial review of the normative documents must be carried out.
