德法治理模式作为影响全人类的治理选择,是马克思主义法学关注的基本命题之一。德法治理选择来源于顺应时势要求的规则取舍和主辅规则之间的兼容空间。习近平总书记提出的依法治国与以德治国相结合思想,是契合时代趋势的基本要求的法主德辅模式,也是中华民族法治史上德法治理模式的新型阶段。从唯物史观揭示的社会发展规律来观照,德法走向一体化将成为社会趋势,"道德法"将成为规则手段演化的必然选项。作为这种趋势的上层反映,国家法治思想应顺应时势,适时取舍,提出全面法治的战略思想。

Xi Jinping＇ s thought of ruling according to something is the basic requirement of the trend of the times,and it is also a new stage of the rule of law or moral in the history of Chinese rule of domination. The rule-based moral comes from the compatibility between the rules and the rules of the main and auxiliary rules. From the social development trend to observe,law and modele go to integration will become social trends. ＂ Moral law＂ will become the inevitable means of evolution of rules.
