摘要
中国公立高校教师取消事业编制的改革已经提上议事日程,但由于教师事业编制与高校法律地位直接相关,所以解决教师编制问题的前提是明确高校的法律地位。目前,一般认为高校在法律上属于事业单位或者法律法规授权的组织,然而随着法治社会的发展,这两种认识都显示出诸多不足,在一定程度上也会阻碍公立高校的发展。在新形势下,有必要借鉴境外成熟做法,引入公务法人制度,通过修法等方式确立高校的公务法人地位,这对推动包括取消教师事业编制等在内的高等教育综合改革有积极作用。
To cancel the public university teachers’ public identities is an important aspect in public higher education reform in China. However, teacher,s government-sponsored quota is related to the legal status ol public universities. People generally view public university as the official department or legal authorized organization. With the development of law-ruled society, these two views have shown a lot of problems and hinders the development of public universities. It is necessary to learn from the foreign experiences adopting a legal fiction system and establishing the status of legal fiction in public universities.
