土地确权的内涵、效应、羁绊与模式选择:一个综述

The Connotation, Effect, Fetters and Mode Selections of the Rural Land Approval: a Broad Overview

基于研究主题和研究思路演进,对农村土地确权的研究发展进行了系统梳理。结果表明:对土地确权"稳定所有权、明晰承包权、放活经营权"内涵的认识有待深化;对于确权的政策效应理论研究和实证分析结果差异较大;对于确权中主体缺位、确权效应差等矛盾揭示较为一致;确权模式选择主要有"确权确地"和"确权确股不确地"两种看法;确权方案选择分化为现状确权、重新确权和微调确权三种观点。在土地确权的成本-收益分析、确权效果推演与政策评价、确权模式的区域适配性和农户群体适配性研究等方面研究仍有待深入。

Based on the evolution of research topic and the research approach, this paper systematically reviews the research and development of rural land approval. The results show that the understanding of the connotation of rural land approval needs to be deepened, which includes ＂Stabilizing the ownership＂ , ＂Clarifying the contract right＂ and ＂Liberalizing the management right＂ . There are great differences between the theoretical research results and empirical analysis results of the policy effect of rural land approval. The announcement of the contradictory about the subject vacancy and the poor effect of rural land verification is comparatively consistent. Mode selections of rural land approval mainly consist of two kinds of perspectives： ＂the verification of right ＆ land＂ , and ＂the verification of right and shares but not the land＂ . The selections of the rural land approval projects are divided into three kinds of opinions： ＂the approving based on present situation＂ , ＂reconfirming approvals＂ and ＂adjusting approvals＂ . The cost-benefit analysis ,deduction of approval effect , policy evaluation, regional suitability and farmers group suitability of rural land approval still need further research.
