摘要
电子商务经济已成为我国经济中一大新的增长点,但在其发展过程中,由于我国法律法规尚不健全,出现的很多问题都引发了极大的争议,其中B2C模式下电子商务合同中的要约与要约邀请的判断在学界及实务界仍不能得出一个一致的判断标准。本文拟从要约与要约邀请的定义及相互关系、B2C模式下电子商务合同的特殊性、现行理论争议的分析、要约认定的可行性路径几个方面来分析网站标价行为的性质,以期为我国《电子商务法》的出台提供借鉴。
E-commerce economy has become a new growth point in China's economy. Due to the imperfect laws and regulations in China, many problems have aroused great controversy during the development process. The criterion of the offer and the invitation of offer in e-commerce contract under B2C mode still needs to reach a consensus between the academic and practical field. This paper attempts to analyze the nature of online pricing in order to provide reference for E-Commerce Law from the aspects of the definition and relationship between the offer and the invitation of offer, the particularity of the e- commerce contract under B2C mode, the current theoretical controversy and the feasibility of the offer.
