族际关系视野下少数民族权益法律保障新探

A New Probe into the Legal Guarantee of Ethnic Minority Rights and Interests from the Perspective of Inter-Ethnic Relations

族际关系是我国作为一个多民族国家所具有的重要社会关系,保障少数民族权益、实现民族事务治理法治化必须重视族际关系的和谐发展。我国长期以来注重少数民族权益保障问题,它是国家解决民族问题的制度需要,是党中央处理民族事务的政策需要,是马克思主义揭示民族发展规律的理论需要。当前,族际关系视野下的少数民族权益法律保障仍存在法制不完备、救济存在困难、权益实现存在障碍等困境。因此,建议从立法层面完善少数民族权益保障相关法律制度,从司法层面增加少数民族权益救济途径,从执法层面确保少数民族权益保障制度的有效实施。

Inter-ethnic relations are important social relations of China as a multi-ethnic country.To guaran-tee the rights and interests of ethnic minorities and realize the administration of ethnic minority affairs by law,im-portance must be attached to the harmonious development of inter-ethnic relations.China has long paid attention tothe protection of the rights and interests of ethnic minorities.It is not only the system requirement of the state tosolve the ethnic minority problems,the policy need of the Party Central Committee to deal with the ethnic minorityaffairs,but also the theoretical need of Marxism to reveal the law of ethnic minority development.At present,thereare still such problems as incomplete legal system,difficulty in relief,and obstacles to realization of rights and inter-ests.in the legal protection of ethnic minorities＇ rights and interests under the view of inter-ethnic relations.There-fore,it is suggested to improve the legal system of minority rights protection from the legislative level,to increase re-lief methods of the minority citizens＇ rights and interests from the judicial level,and to ensure the effective imple-mentation of the minority rights and interests protection system from the law enforcement level.
