The Nature and Distribution of Death Compensation

死亡赔偿金的分配问题在我国立法中一直处于空白状态,这一立法的缺失与死亡赔偿金性质的确定之间有着千丝万缕的关系。由于相关规范的缺失,使得死亡赔偿金的分配在司法实践中没有统一的标准,往往会出现不同的裁判结果。文章以对死亡赔偿金性质的分析为基础,对死亡赔偿金分配的主体、原则等问题进行讨论,希望能够有效处理这类案件。

The problem of the distribution of death compensation has been in a state of blank in the legislation in our country, which is related to the lack of the rules and the property of the death compensation. Due to the lack of related specifications, there aren＇t unified standards to the distribution of death compensation in the judicial practice which resulted in the appearing of different referees. Based on the analysis of the property of death compen- sation, this article discusses the subject and the principle of the distribution of death compensation provides necessa- ry reference to deal with the cases of death compensation effectively.
