On the Criminal Law Situation of the Internet Platform Provider under the Background of “Managing Internet Relying on the Internet”

在"互联网+"时代,网络平台服务提供者扮演着提供交换资源、承担组织调度的角色,已成为身处网络活动第一线的管理者。在法定义务以及与网民协定契约的共同塑造之下,网络平台服务提供者拥有了网络监管中的"软权力",进而引申出"以网管网"的命题。为了确保网络平台服务提供者积极履行"以网管网"职责,《刑法修正案(九)》引入拒不履行信息网络安全管理义务罪,该罪采取了概括式罪名模式,条文辐射的范围过宽,难以为司法机关对其进行刑事追责提供确定性约束。鉴于此,裁判者应秉持"兼顾互联网行业发展与网络犯罪治理"的基本立场,严格拿捏"不履行法定义务的规范依据与实质内容、责令改正意见的明确性以及义务违反与危害后果间的因果关系"等限制要点,确定该罪名在司法适用中的法治边界,并尝试通过科学的释法来获取该罪名在司法实践中正当的适用范式。

At the'Internet+'Age,IPP plays a role as the resource exchanger and organization scheduler,which is the frontline regulator of internet activities.Under the jointly effect of both legal obligations and contractual agreements with its users,IPP owns the'soft power'on the internet,resulting in the proposal of'managing internet relying on the internet'.To ensure the IPP to actively fulfill its management role,the Criminal Law Amendment(ix)introduces an article for the crime of'refusing to perform network security management duties'.This article is regulated under the generalization formula mode and the range is too wide to provide certainty for criminal justice.Therefore,judges applying this article should be under the consideration of both internet industry development and cybercrime governance,ascertaining the normative grounds and substantive facts of'failure to fulfill legal obligations',the specification of'ordering to correct opinion',and the causal link between the breach of duty and the harmful consequences.Judges should establish the rule of legality border in judicial application,and try to get the applicable paradigm in judicial practice through scientific interpretation.
