摘要
随着科技进步,大量新业态得到发展,在其成长的背后,预示着非标准劳动关系势在必行。然而非标准劳动关系目前仍存在概念界定不清、司法实践混乱、对于非全日制用工法律保护薄弱等问题,这对我国建立和谐劳动关系形成了挑战。因而有必要加强劳动合同法的包容性,认清非标准劳动关系的本质特征——劳动者对用人单位的组织从属性和技术从属性。将最低标准的保护与劳动力市场灵活性的要求相平衡,逐步规范非全日制用工,完善当前社会保险制度,提高劳动力市场的灵活性,以适应时代发展。
With the progress of science and technology, a large number of new forms of development, behind their growth,indicate that non-standard labor relations are imperative. However,there are still some problems in the definition of non-standard labor relations,the chaos of judicial practice and the weak legal protection of part-time employment,which poses a challenge to the establishment of harmonious labor relations in China. Therefore,it is necessary to strengthen the inclusiveness of the labor contract law, recognize the essential characteristics of non-standard labor relations—the organizational nature of the workers and the technical attributes of the employer. It is important to maintain the minimum standard protection and labor market flexibility requirements, and gradually standardize part-time employment, perfect the current social insurance system and improve the flexibility of the labor market to adapt to the development of the times.
