党内法规的价值维度研究

Study of Value Dimension of the Laws of the Party

十八届三中全会将国家治理体系定位于党领导下的国家管理制度体系,同时将依法治国与依规治党明确为推进国家治理体系现代下的两个重要抓手。在依法治国已经具备了明晰的图景下,研讨党内法规对依规治党有着重大的作用和意义。党内法规作为执政党自治和治理国家的根本准则,有三个基本的价值维度:秩序价值、规范价值、法治价值。三个价值维度因执政党和国家面临的任务形势不同而交错发挥作用,正确认识和处理党内法规的基本价值体系,对理解当前的纪在法前、纪比法严,以及如何加强从严治党特别是依规治党、依法执纪建设将大有裨益。

The Third Plenary Session of the 18th Central Committee established a national administrative system under the leadership of the communist party, and the same time took the running state according to the rule of law and managing the party according to the regulations as two important grabs to promote the national administrative system. When having a clear prospect of running state according to law, studying the party regulations has a significant role in running the party accord- ing to regulations. There are three basic dimensions of value of the party＇s laws as the essential rule of managing country： the value of order, the value of the rule and the value of the rule of law, which are playing the interlaced roles in different tasks faced by the ruling party and the state. Having a correct understanding and handling the basic value system of the in- ner-party laws and regulations is of great benefit in understanding of the current discipline that the party＇s regulations are more important than laws and how to strengthen the strict with the party, especially to run the party in accordance with the law.
