职务犯罪技术侦查相对人权利保障问题研究

A Research into Protecting the Rights of Administrative Counterparts when Using Technical Investigation in Combating Duty Crimes

在职务犯罪技术侦查中,通过赋予相对人相应的权利以制约公权力,可为刑事诉讼权利保障目标的实现提供新的路径。立足立宪主义的刑事程序法治视野,有关职务犯罪技术侦查的规范不仅仅要赋予个人主观性基本权利,落实公民在公法上的防御权,更应使整个规范建构在对个人权利尊重和保护的客观价值秩序之上。在我国,基本权的防御功能与司法救济并未建立结构性连接,而作为客观价值的属性的基本权理论更鲜有涉及。技术侦查中所关涉的公民隐私权和通信自由权等基本人权,也有同样际遇。应当发挥我国以"两高"为主体的法律解释功能,以已经确立的"人权保障"目标为旨归,经由体系化的创造性解释,实现制度及理念的系统变更,促进刑事诉讼向人权保障的应然价值回归。

When using technical investigation to solve duty crime cases, vesting administrative counterparts with corresponding rights could have the function of balancing public power, thus providing new approaches to realizing the goal of guaranteeing lawsuit rights. Based on rule of law in accordance with constitution principles, regulations concerning technical investigation for duty crimes are expected not only to vest individuals basic rights and realize defending rights in terms of public law, but also to establish the whole regulation on the base of respecting individual rights and defending object value discipline. Domestically, constructive links haven＇t been set up between the defending functions of basic rights and legal redressing. There has also been little basic rights theory with objective values. This is also the situation for basic human rights, such as privacy rights and freedom of correspondence, in technical investigation. Thus, the law interpretation function of the Supreme Court and the Supreme Procuratorate should be exercised. Aiming at the existing goal of defending human rights, systematic creative interpretations can realize the systematic changes in mechanism and ideas, orooelling criminal orocedures towards the necessary value of orotecting human rights.
