我国对南海拥有的历史性权利研究

China's Historical Rights of the South China Sea

文章通过对历史性权利的构成要素进行分析,将这一权利具体拆分成为历史性通行权、历史性捕鱼权和历史性海底能源所有权三块,并将三者放在国民经济发展、国家能源运输安全和国家可持续发展战略的现实背景下进行分析,通过将抽象的概念具体化,以论证我国当前南海护航、护渔、护能源的正当性、必要性和迫切性。

The constituents of historical rights are analyzed. It includes the historical right of wayleave,fishing,and seabed resource. The three factors are analyzed from the per- spective of the economic development, transportation security and sustainable development. By making the abstract concepts concrete, the legitimacy, necessity and urgency of the prac- tice of escort for business ships, fishing ships, and ships for energy transportation are argued.
