Orientation and Innovation: Scientific Construction of the Procuratorial Supervision Mechanism of Administrative Compulsory Measures

行政强制措施检察监督制度的设计出台,是一项将权力关进制度笼子的重要司法改革举措。创新检察监督机制,需认清行政强制措施检察监督的内涵、职能定位,并分析检察机关具有的制度优势及面临的多种困境。在明确检察监督原则与权力边界的基础上,着眼检察监督规律,从更新监督理念、重构监督模式、优化监督机制、创新监督方式等四个层面,提出创新行政强制措施检察监督机制的基本路径。

The procuratorial supervision system of administrative compulsory measures has been designed and promulgated, that is an important judicial reform to put the power into the system of cage. In order to innovate the procuratorial supervision mechanism, we should recognize the connotation and function orientation of the procuratorial supervision of administrative compulsory measures, and analyze the system’s advantages and various difficulties of the procuratorial organs. On the basis of making clear the prosecutorial supervision principles and powers boundary, focus on the procuratorial supervision rules, this article puts forward the basic path of the procuratorial supervision mechanism of administrative compulsory measures from four aspects： Firstly, update the supervision concept. Secondly, reconstruct the supervision mode.Thirdly, optimize the supervision mechanism. Fourthly, innovate the supervision method.
