未成年人专业化刑事审判机制实证研究——以四川省泸州市2015年数据为样本

以司法行政机关职能协调为视角,针对未成年人专业化刑事审判机制进行实证研究可知,我国少年法庭受理范围规定未区分未成年人轻、重罪案件;对合适成年人应参与而未参与诉讼没有惩戒措施;少年法庭开展判后延伸工作过度;未成年人社会调查实施不统一,调查表设置笼统。应根据实际情况确定少年法庭受案范围;完善公设适当未成年制度和保障机制;各部门协调配合,专门机构统一负责,建立帮教一体的少年犯教育矫正体系;由司法机关牵头,具有专业资质的第三方公益平台组建调查小组实施未成年人社会调查工作。

From the angle of function coordination of the judicial administrative organs, Aiming for the empirical research on the specialized criminal trial mechanism of Juveniles shows that, the acceptance scope of our country’s juvenile courts does not distinguish between misdemeanor and felony cases. Led by judicial organs, an investigation team should be set up to carry out social investigation for Juveniles conducted by a professional quality of the third party welfare platform.
