Ruling the Ethnic Affairs by Law under the New Development Concept

党的十八届五中全会提出了新发展理念。在新发展理念的背景下,依法治理民族事务的内涵是广大人民群众在党的领导下,立足发展、问题、创新、协调、绿色、开放、共享等基本理念,依照宪法和法律的规定,通过各种法律手段、途径和形式,运用法治思维和法治方式,解决民族关系公共事务问题,逐步实现民族事务治理法治化以及民族关系科学发展的创造性活动;依法治理民族事务的重点是在依法治理民族事务的进程中贯彻新发展理念;依法治理民族事务的难点是厘清民族事务与依法治理的关系以及依法治国与依法治理民族事务的关系;依法治理民族事务的根本是用法治思维和方式来做好民族工作,用法律来保障民族团结,用民族事务治理法治化来促进民族关系的科学发展。

The new development concept was put forward in the fifth plenary session of the 18th the central committee of the Communist Party. Under the background of the new development concept, the connotation of the ruling the ethnic affairs by law is a creative activity, the feature of which is that the people are supposed to solve the problems of the public affairs concerning national relations in accordance with the provisions of the constitution and the law, by way of a variety of legal means, approaches and forms, as well as in the legal frameworks with legal actions. The creative activity must be under the leadership of the Party and based on the fundamental conceptions such as development, problems, innovation, coordination, greenness, openness, and sharing to gradually achieve the ruling the ethnic affairs under the rule of law and the scientific development of the national relationship. The focus of the ruling the ethnic affairs by law is to carry out the new development concept in the process of it. The difficulty of it is to clarify the relationship between the ethnic affairs and the rule of law, as well as the relationship between the ruling the country by law and the ruling the ethnic affairs by law. The root of it is to do a good ethnic job in the legal frameworks with legal actions, to safeguard the ethnic unity by law and to promote the scientific development of ethnic relations with the rule of law in the affairs of ethnic matters.
