伴随着市场经济的迅速发展和社会的不断进步,民间借贷市场日益活跃,专业融资机构逐步兴起,借贷市场逐步由消费性借贷转变为生产经营性借贷,但随之违法犯罪规模也越来越大,犯罪事件已对社会发展造成负面影响。当前,针对民间借贷违法犯罪行为的法律制度仍不够完善,导致司法认定和社会认知产生混乱。基于此,对民间借贷违法犯罪及法律适用问题进行了探讨。

Along with the rapid development of market economy and the ongoing progress of the society, the private lending market has become increasingly active, and professional financing institutions also rise gradually, and the lending market has gradually transformed from the consumer lending business lending into the lending of production and operation. However, with the growing scale of illegal criminal activities, the crime has excreted a negative impact on the social development. At present, the legal system for the illegal criminal behaviors of private lending is still not perfect, which leads to the confusion of judicial confirmation and social cognition. Based on this, this paper explores the illegal crime and legal application on the private lending.
