论农村利益多元化冲突的法律调控

Discussion on Legal Adjustment and Regulation of Diversification Conflict of Rural Interests

市场经济的发展与改革开放的深化致使社会结构急剧调整,社会转型加快,从而引发一些新的社会问题。文章通过对我国农村利益多元化及冲突多元化现状及原因的分析,提出要增强法律在农村社会中的作用,保护农村各利益主体的合法权益;建立相应的法律预防及惩罚措施,保障惠农政策的实施,完善农村土地征收制度;建立有效的多元利益诉讼渠道,加强村民自治的法治化,用法律来调控农村利益多元化的冲突。

During the ＂Twelfth five-year＂period, the development of market economy and further deepening of reform and opening up led to a significant adjustment of social structure and acceleration of social transformation, resulting in the emergence of some new social problems such as the configuration of social characters, the distribution of interests etc. Pattern of China＇s rural interests is further differentiated, showing a trend of diversification. Through an analysis on the situation and causes of the interests diversification and conflict diversification in China＇s rural areas, it is proposed that on the rule of law concept, the role of law in rural society should be strengthened, and the legitimate rights and interests of all stakeholders should be effectively protected; in the legislation, the relevant legal system should be perfected, making the interests protection of stakeholders have lawfully recognized evidence; in practice, the legalization of villagers＇ autonomy should be strengthened by establishing effective rural multivariate interests appeal channels and establishing＂law-ruled rural areas＂.
