摘要
我国自2008年1月1日实施《城乡规划法》以来,各地纷纷依照《城乡规划法》制定城乡规划地方法规,特别是2015年修改后的《立法法》将城乡规划立法权扩大到所有设区的市之后,制定城乡规划地方法规的城市日渐增多。通过对城乡规划地方立法情况进行梳理后发现,受立法体制、城乡二元结构、立法专业化水平、公众参与意识等因素的影响,我国城乡规划地方立法仍存在缺乏地方特色、可操作性不强、部门利益倾向、行政机关主导立法等诸多问题。对此,本文提出了更新立法观念、提升立法质量、改进各主体诉求表达方式、构建立法配套程序等建议,以期为完善我国城乡规划地方立法提供参考。
Since the promulgation of the Urban and Rural Planning Law in 2007,since January 1,2008,all localities have formulated local laws and regulations for urban and rural planning in accordance with the Urban and Rural Plan- ning Law.In particular,the new "legislation" in 2015 will extend the legislative power of urban and rural planning to the cities all districts.Based on the summary of local urban and rural planning legislation,found by the legislative system of urban and rural areas,two Yuan structure,legislation of professional level,social participation and other factors ,urban and rural planning of local legislation in China there is a lack of local characteristics,operability is not strong,prone to many problems,departmental interests of administrative organs leading legislation.To solve these problems,put forward legislative ideas,update and improve the quality of legislation,improve the legislative construction of the main demands of expression,supporting the program path to improve the local urban and rural planning legislation,in order to urban and rural planning legislation in China to make a modest contribution.
