我国法治反恐的思维向度及其常态化

The Thinking Mode and Normalization of Anti-Terrorism in the Rule of Law in China

《反恐法》的施行是我国走向法治反恐的里程碑。我国法治反恐思想内涵丰富,具有严谨的法理逻辑和深厚的哲学意蕴,凸显了以人为本的价值向度,呈现了标本兼治的方法向度,贯穿了长治久安的实践向度。这三个思维向度分别是我国法治反恐的基础、方法和目标,系统地回答了如何认识法治反恐、怎样推进法治反恐和如何践行法治反恐三个层面的重大理论问题和现实问题。为实现我国法治反恐的常态化,需要从外部营造尊法尚法的法治环境,在内部夯实从法律认知到法治反恐实践的根基,建构系统化的法律体系和制度化的保障机制,使法治反恐成为我国反恐实践的普遍认知和惯性思维。

The implementation of the Anti-Terrorism Law marks a milestone in China＇s efforts towards the rule of law a- gainst terrorism.The thought of anti-terrorism by law in our country is rich in connotation,which has rigorous legal logic and profound philosophical implications,that highlighted the people-oriented value orientation,presents the method of treating the symptoms and runs through the practice of peace and stability.These three dimensions of thinking are the basis,methods and goals of anti-terrorism in the rule of law in China,which systematically answers the important theo- retical problems and practical problems of how to understand the anti-terrorism of the rule of law,how to promote the rule of law against terrorism and how to practice the three aspects of the rule of law and terrorism.In order to realize the normal operation of anti-terrorism ruled by law in our country,it is necessary to build a legal environment of re- specting law and law from outside,consolidate the foundation from the legal cognition to the anti-terrorism practice of the rule of law,push forward the ＂anti-terrorism law＂ comprehensively landing,construct a systematic legal system and institutionalized guarantee mechanism,to make the anti-terrorism of the rule of law become the general cognition and inertial thinking of anti-terrorism practice in china.
