哲学视阈下的社区矫正

Community Correction from the Perspective of Philosophy

社区矫正作为一种与监禁矫正相对的刑罚执行方式,是司法制度的一项重要改革,引起了人们在法律视阈下对其的广泛关注和研究。但社区矫正作为制度文明和社会进步的产物,其必然符合也必须遵循马克思主义哲学所揭示的社会基本理念和社会发展基本规律。本文从哲学的角度,将社区矫正置于哲学的视阈下,研究其产生的必然性和发展的规律性,并以哲学所揭示的基本规律为指导,提出推进社区矫正深化发展的可行性措施。

Community correction, as a relative punishment execution way of imprisonment, is an important reform of the judicial system, which causes people＇s extensive attention and research in the legal threshold. However, community correction as the product of civilization system and social progress, it must also follow the basic law of social basic ideas and social development revealed by Marxist philosophy. From the perspective of philosophy,this paper puts the community correction in the perspective of philosophy, studies the inevitability and the development of its regularity,and puts forward the feasible measures to promote the development of community correction.
