Boundaries of Speech and Legal Regulations in the Context of New Media

言论自由是现代法制社会中公民的一项基本权利,各国宪法都将其作为重要内容加以确定和保障。随着互联网的蓬勃发展,自由言论被赋予了新的理念和表现形式。在网络环境下,通过虚拟的表达途径行使言论自由更容易引发各种利益之间的矛盾和冲突。虽然我国宪法中对言论自由已有所规定,但网络环境下言论自由的无限扩张与政府对网络环境下各种有害和违法言论的控制能力有限,网络环境下的公民言论自由的保障与限制成为现代民主法治国家必须认真对待的重要法律问题。因此,加强对公民网络言论自由的保护和规制是现代法治发展的必然要求。

Freedom of speech is a basic right of citizen in modern legal society,each country＇s constitution consider it as an important content to identify and protect. With the vigorous development of the Internet,free speech is endowed with new concepts and forms. Under the network environment,through the virtual expression way of the exercise of freedom of speech,it is more likely to encounter all sorts of interests between the conflict and contradiction. Although there has been a provisions of the constitution for freedom of speech in China,the unlimited extension of free speech under the network environment and the government under the network circumstance of various harmful and illegal speech control ability is limited,the guarantee of citizens freedom of speech under the network environment and limit to become a modern democratic country under the rule of law must seriously be considered as an important legal issues. Therefore,to strengthen the protection of citizens＇ network freedom of speech is necessary for the development of the modern rule of law and regulation.
