论刑法“过程危机”的金融之维

On the Financial Dimension of “Process Crisis” in Criminal Law

过程危机论沿袭了法兰克福学派的系统论与批判传统,为当代马克思主义与中国特色社会主义刑法理论的发展注入了新的源泉与动力;从奥菲提出过程危机的概念中可以提炼出"活的东西",继而跳出哲学范畴,完全可以运用到当下中国的刑法之中;不仅本土刑法中有适合过程危机的文化土壤,而且制度思想体系也一脉相承。在对金融刑事规范修正的批判和对典型案例的反思中,可以用实证分析出中国刑法确已存在稳定性之过程危机。未来,金融刑法处于一种在摇摆中寻找平衡的状态,社会环境的稳定只决定了金融刑法更加多元化、专业化与体系化的基本方向,但金融创新与制度滞后的正负合力却导致了其摇摆态势。研究者们主流学术使命只有回归到批判与反思之中,才能迎接过程危机给刑法带来的新挑战。

The process crisis theory, inherited from the system theory of the Frankfurt School and their critical tradition, has injected new sources and powers for the new development of contemporary Marx doctrine and the criminal law with Chinese socialist characteristics; Extracted the ＂living matters＂ from Offe＇ s concept of process crisis, it jumped out of philosophical category and available to current criminal law in China. The process crisis found out both its proper culture to develop and the same stem of ideological system. Through correcting financial criminal norms and reviewing typical cases, we can dig out the existing crisis affecting the stability of Chinese criminal law by empirical analysis. In future, the financial criminal law would be in the search for balance in swing state.The stability of social environment only determines the basic direction of fi- nancial criminal law-- more diversified, specialized and systematized, but the positive and negative effect of financial innovation and the lagging system has led to itsswing trend. Only through the major mission＇ s returning to criticism and reflection, scholars would meet the new challenges brought by the process crisis to criminal law.
