摘要
以电商交易、餐饮外卖、出行应用和互联网系统为代表的网络刷单严重扰乱了正常的市场交易秩序,有必要对其进行法律分析。经营者的非理性博弈、平台的自利性纵容、消费者的搭便车心理都在一定程度上加剧了这一现象。刷单作为互联网领域的新型不法行为,通常应由反不正当竞争法、消费者权益保护法和互联网交易管理办法进行规制。要有效落实炒单刷信者的法律责任,应当在"软法"与"硬法"的二元结构中,在平台自律、行业调制与国家强制的三维视域下,依照社会规范和法律的有关规定,确凿落实行为人民事、刑事与行政等多个方面的责任。
Wash sale occurs in online shopping, takeout, traveling application and other Internet application, which has seriously influenced market order online. It is necessary to carry out legal analysis on this problem. The irrational game of the operator, the self-serving co.nnivance of the platform, the consumer' s free-riding psychology have intensified this phenomenon to a certain extent. As a new type of illegal acts in the Internet field, wash sale should be subject to anti-unfair competition law, consumer rights protection law and Internet transactions management regulations. To effectively pu sue wash sales operator' legal responsibility, it is supposed to observe social norms, laws and regulations under the dualstructure of soft law and hard law with three-dimensional perspective of platform' s self-discipline, industry association' s supervision and law.
