The Influence of Circumstances Outside the Case on the Use of the Death Penalty for Drug Crimes

基于行为人刑法及对刑罚特殊预防目的的考虑，及刑法对死刑适用标准的设定。犯罪前、后的情节也会对死刑适用发挥影响。本文论述了毒品犯罪死刑适用中案外情节的类型和具体认定，分析案外情节适用特点，并从程序设计、证据收集主体、证明标准等方面探讨案外情节如何才能对死刑适用发挥作用。

Based on consideration of actor factor and special prevention of penalty purpose, and application standard of death penalty set by criminal law, circumstances before and after crime also exert influence on decision of death penalty. This paper discusses the types and determination of circumstances besides crime in the course of decision of death penalty in drug crime, analysizes the applicable characteristics of circumstances besides crime, and explores how to exert influence on decision of death penalty from aspects of procedure design, subject of proof collection, and standard of testification.
