中俄反腐败法律规制体系比较研究

The comparative analysis of the anti-corruption legal system in Russia and China

中俄两国在法律体系方面有着特殊的传承关系，而且都经历过社会转型的阵痛，因此，立足于中俄两国反腐败法律体系现状的分析与探讨，以《联合国反腐败公约》为主线，结合其他相关国际公约，构建适合中国国情的反腐败法律规制体系是当下中国反腐败的当然路径。中国反腐败法律规制体系应当在统一的反腐败国家政策指导下予以完善，尽快出台一部专门的《反腐败法》、起草并颁布《中华人民共和国规范法案及其草案的反腐败评估法》、建立反腐败的民事机制、完善反腐败刑事机制、完善我国反腐败的国际合作机制，以使中国国内法最大限度地与《联合国反腐败公约》相契合。

There are some special inheritance between China and Russia in the aspect of legal system, and they both have been in the throes of social transformation. Therefore ,based on the analysis and discussion of the present situation of antl-corruption legal system between China and Russia, set the United Nations Convention against Corruption （UNCAC） as the main line, combining with other relevant international conventions, construct the anti-corruption law regulation system of China＇s national conditions is the present China＇s anti-corruption Inevitable path. Anti- corruption legal regulation system of China should be perfect under the guidance of national anti-corruption policy, take off a special ＂ anti- corruption law＂ as soon as possible, drafted and issued the law ＂Anti- corruption expertise of normative legal acts and drafts of normative legal acts in the PRC＂, establish the anti-corruption civil mechanism, perfect the anti-corruption criminal mechanism, improve the mechanism of international cooperation against corruption in our country, so that China＇s domestic law will extent with the United Nations Convention against corruption to the maximum.
